Terms and conditions
Scope of application:
The website www.pandmofficial.com is operated by P&M TWO GmbH (hereinafter P&M). These General Terms and Conditions (GTC) apply to sales contracts with private customers and companies (hereinafter the customer) which are concluded via the website www.pandmofficial.com.
For purchase contracts concluded in any other way, e.g. by telephone, fax or letter, these GTCs shall also apply. The customer is advised that the general terms and conditions can be found on the website www.pandmofficial.com.
P&M reserves the right to change the terms and conditions at any time. Decisive is the version of the AGB valid at the time of the order. Deviating terms and conditions of the Customer shall only apply with the written consent of P&M.
Offer and conclusion of contract:
The presentation of the products on www.pandmofficial.com is not a legally binding application, but only a non-binding online catalogue. The offers on www.pandmofficial.com are subject to change. The order is only contractually binding for P&M after confirmation to the customer.
The prices are indicated in CHF, GBP, EUR and USD including value added tax. P&M reserves the right to change the prices at any time. For customers, the prices published on the website www.pandmofficial.com on the date of the order shall apply.
Delivery & Shipping costs:
P&M will deliver the ordered goods to the address specified by the customer in the order. P&M is entitled to make partial deliveries. This does not result in additional costs for the customer. The delivery shall be made at the shipping costs stated in each individual case.
Delivery time: The delivery time is 3-5 working days for standard shipping and 1-2 working days for express shipping. The expected delivery time will be communicated to the customer upon acceptance of the order. After 14 calendar days from the provisional delivery date, the customer may cancel the order for the product in question and any payments already made will be refunded. Further claims are excluded. Information about the expected delivery date is not binding, unless P&M has given the Customer a binding promise in an individual case.
Orders in the EU and Switzerland: P&M delivers to countries in the European Union and Switzerland on a ddp (delivery duties paid) basis. This means that all applicable taxes and duties are included in the final purchase price when the order is placed and that no additional costs are incurred for delivery. The price you see is the price you pay.
Orders outside Europe: All international orders outside the European Union are shipped duty unpaid (ddu). This means that they may be subject to import charges, which are to be borne by the buyer. Customs duties, charges and taxes are not included in the item price or in the shipping costs at the checkout. The customer is responsible for all duties, taxes and fees upon delivery. We cannot predict what the specific charges will be. For more information about the customs regulations in your country, please contact your local customs office.
The means of payment indicated on www.pandmofficial.com are valid. P&M may exclude individual means of payment generally or for individual customers without further justification. When purchasing with credit cards, the charge is made at the time of the order.
In the event of late payment, P&M is entitled to withdraw from the contract and to demand the return of the purchased goods.
If P&M is not able to deliver the ordered product through no fault of its own, in particular because P&M's suppliers do not deliver the products on time, P&M has the right to cancel the confirmed orders. Payments already made will be refunded.
Right of withdrawal and exchange:
The cancellation and exchange is possible if an order contains 3 or less items. Orders placed by a customer on the same day will be considered as one order in this respect.
The customer is entitled to cancel his order without giving reasons within 14 calendar days after receipt of the goods by e-mail to email@example.com. The period begins with receipt of the goods. The timely dispatch of the revocation suffices to meet the deadline.
P&M reimburses the customer for the payment made in the form of a voucher.
In the event of an effective cancellation, the customer is obliged to return the received goods. The customer must return the goods in perfect condition and with the original packaging to the following address

The customer bears the burden of proof for the dispatch of the goods to be returned. The customer bears the costs of the return shipment (including customs duties, charges, taxes and fees) and shipping costs from the re-shipment (in case of exchange).
After receipt of the goods, the full purchase price (excluding shipping costs) will be refunded to the customer immediately in the form of a voucher. We reserve the right to deduct the refundable purchase price for possible damage or excessive wear and tear of the goods.
Warranty and liability:
P&M warrants for a period of 24 months that the goods have the warranted characteristics, that they have no defects affecting their value or suitability for the intended use and that they comply with the prescribed performance and specifications.
The customer must check the delivered goods as soon as possible and report any defects within 14 calendar days. The responsible customer service can be found in the imprint.
If there is a defect, P&M may choose to provide the warranty either by repairing the defect free of charge or by delivering a replacement. Insignificant deviations from warranted characteristics of the goods shall not trigger any warranty rights. Liability for normal wear and tear is excluded. The liability according to the product liability law remains unaffected.
No liability is accepted for consequential damage resulting from the use of the products. Claims for damages due to incorrect illustrations, texts and prices or delayed deliveries are excluded.
Further claims of the customer are excluded, regardless of the legal grounds.
Applicable law and place of jurisdiction:
Swiss law is applicable to the present contract. The provisions of the CISG are excluded. The place of jurisdiction for disputes arising from or in connection with this contract is Pfäffikon ZH.
We are also entitled to take legal action at your general place of jurisdiction.
The invalidity of individual provisions shall not affect the remaining effectiveness of the contract and these General Terms and Conditions.
